In 2002, the European Charter of Patients' Rights was drafted. The European Charter of Patients' Rights declares the 14 rights of patients which, together, are intended to guarantee a "high level of human health" (Article 35 of the Charter of Fundamental Rights of the European Union) and to ensure the high quality of services provided by health agencies in Europe.

These 14 rights are the basis of the Fundamental Rights that should be recognized in each country. They are related with obligations and responsibilities to be undertaken by citizens and all those involved in providing health services. The Charter applies to all individuals, recognizing that differences such as age, sex, religion, socio-economic status, etc. may affect individual health needs.

1. RIGHT OF PREVENTION
Everyone has the right to enjoy the provision of appropriate services to prevent disease.

2. RIGHT OF ACCESS
Everyone has the right of access to health services, as required by the state of health. Health services should ensure equal access for all without distinction as to their economic status, place of residence, type of illness or time of access to services.

3. RIGHT OF INFORMATION
Everyone has the right to access any kind of information on the state of health, health services and how to use them as well as all available scientific research and technological innovation.

4. RIGHT OF CONSENT
Everyone has the right to access any kind of information that can help to actively participate in decisions concerning their health. This information is provided for all medical practices and procedures, including participation in clinical trials.

5. RIGHT TO FREEDOM OF CHOICE
Everyone has the right freely to choose between different therapeutic procedures and health providers on adequate information.

6. RIGHT TO DISCLOSURE AND CONFIDENTIALITY
Everyone has the right that personal data remain confidential, including data on health status and potential diagnostic or therapeutic procedures and that privacy is protected at the time of performance of diagnostic tests, visits to specialty physicians, and general medical / surgical instruments.

7. RIGHT TO RESPECT THE TIME OF THE PATIENT
Everyone has the right to receive the necessary treatment in a short and predetermined time. This right is valid for each phase of treatment.

8. RIGHT OF COMPLIANCE WITH QUALITY STANDARDS
Everyone has the right of access to high quality health services according to specifications and with compliance to specific standards.

9. RIGHTS OF SECURITY
Everyone has the right to avoid damage caused by improper functioning of health services, medical errors and mistakes, and access to health services and treatments that meet strict safety standards.

10. RIGHT OF INNOVATION
Everyone has the right of access to innovative procedures, including diagnostic procedures, in accordance with international standards and independently of economic factors.

11. RIGHT OF AVOIDANCE OF UNECESSARY SUFFERING AND PAIN
Everyone has the right to avoid, to every possible extent, suffering and pain in every phase of his illness.

12. RIGHT OF INDIVIDUALIZED THERAPY
Everyone has the right to diagnostic or therapeutic methods designed, where possible, to individual needs.

13. RIGHT OF EXPRESSION OF COMPLAINTS
Everyone has the right to complain whenever damaged and the right to receive a response or other information.

14. RIGHT OF INDEMNITY Every person has the right to receive adequate compensation within a reasonably short time whenever has suffered physical or moral and psychological harm from any  medical practice, provided by a health service.
